La Commission du titre de séjour (CTS) is an advisory body established under le Code de l’entrée et du séjour des étrangers et du droit d’asile (CESEDA).

 

 

Its main role:

 

It is consulted when the préfet considers refusing to renew or issue a residence permit in certain specific cases (particularly for foreigners who are entitled to a residence permit ‘by right’).

 

 

 

Objectives:

To guarantee the rights of foreigners: it ensures that the prefect’s decision is not taken arbitrarily.

To give an advisory opinion: the commission issues a favourable or unfavourable opinion on the prefect’s proposed refusal of residence.

To ensure a collegial review: the foreign national may be heard by the commission, which includes representatives of associations, local elected officials and representatives of the State.

 

 

 

How it works:

It must be consulted in certain cases (for example, when the refusal concerns a sick foreign national, a parent of a French child, or a person who has been residing in France for a long time).

The commission’s opinion is not binding: the prefect may override it, but must take it into account and justify their decision.

 

 

What should I do if I have been summoned to appear before the commission?

There are 2 options :

  1. Go alone and demonstrate your successful integration in France, highlighting your fluency in French and your cultural adaptation.

  2. Be accompanied by an immigration professional ( a skilled lawyer) who can help you prepare and present your case effectively before the commission. TSA is there to help you!
